The New York State General Municipal Law was recently amended to permit notices of claim against public corporations to be served on the Secretary of State beginning July 15, 2013. A “public corporation” is defined as a “municipal corporation, a district corporation or a public benefit corporation.” After the Secretary of State receives the notice of claim, they will then send a copy of the notice to the public corporation.
Beginning on June 17, 2013, public corporations that choose to utilize this service will be required to file a certificate with the Department of State designating the Secretary of State as their agent for service of notices of claim. The new notice of claim form has already been developed; however, it is not yet available on the Department of State’s website and there has been no mention regarding what the associated filing fees might be.
